1. Definitions
- "Service" refers to the Propose Professional platform, including the mobile application, dashboard, and related features.
- "User" (or "you") refers to any individual or entity using the Service, including patients, physiotherapists, and clinic administrators.
- "Physiotherapist" refers to a qualified healthcare professional using the platform to monitor or support patients.
- "Content" refers to all materials, data, outputs, and information available through the Service.
2. About the Service
These Terms govern your use of Propose Professional provided by ProposeTech Limited ("Propose", "we", "us"). By creating an account or using the Service, you agree to these Terms.
3. Nature of the Service
The Service provides a digital platform for physiotherapy support using movement analysis and feedback. It supports exercise tracking and monitoring and enables interaction between Users and Physiotherapists.
The Service does not provide medical diagnosis, treatment, or emergency care.
4. Eligibility
You must be at least 16 years old and provide accurate and complete information.
5. Health Data and Consent
Certain features of the Service require the processing of health-related data. By using the Service, you acknowledge that you will be asked to provide explicit consent for the processing of health and movement data, which is used to deliver physiotherapy support, progress tracking, and clinician monitoring.
6. No Medical Relationship
Use of the Service does not create a doctor-patient relationship between ProposeTech Limited and any User.
7. Physiotherapist Responsibility
Physiotherapists using the Service are solely responsible for clinical decisions, treatment plans, and advice provided to patients. ProposeTech Limited does not control or assume responsibility for clinical outcomes.
8. User Responsibilities
You agree to use the Service only for its intended purpose, follow guidance provided by qualified healthcare professionals, and perform exercises safely and within your personal limits.
If you experience pain, discomfort, worsening symptoms, or any unexpected physical reaction while using the Service, you must immediately stop and consult a qualified healthcare professional before continuing.
You must not use the Service unlawfully, attempt to gain unauthorized access to systems or data, interfere with or disrupt the Service, or reverse engineer or misuse the platform.
9. Accounts
You are responsible for maintaining the confidentiality of your account and all activity conducted under your account. We may suspend or terminate accounts in case of misuse or violation of these Terms.
10. Data and Privacy
Your use of the Service is subject to our Privacy Policy. By using the Service, you acknowledge that your data will be processed in accordance with applicable data protection laws, including UK GDPR.
11. Intellectual Property
All platform content, technology, software, algorithms, analytics, designs, and materials are owned by or licensed to ProposeTech Limited and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, reproduce, or create derivative works from any part of the Service without prior written permission.
12. Service Availability
We do not guarantee uninterrupted or error-free access to the Service. We may update, modify, or discontinue features, or perform maintenance and upgrades.
13. Limitation of Liability
To the maximum extent permitted by law, ProposeTech Limited shall not be liable for any indirect, incidental, or consequential damages, including loss of data, loss of profits, or health-related outcomes arising from use of the Service.
Our total liability to you shall not exceed the amount paid by you for the Service in the previous 12 months, or £0 if the Service is provided free of charge.
Nothing in these Terms excludes liability where it cannot be excluded under applicable law.
14. Termination
We may suspend or terminate access to the Service if these Terms are violated or misuse or security risks are identified. You may stop using the Service at any time.
15. Governing Law
These Terms are governed by the laws of the United Kingdom.
